I understand we are obligated to accept an on-us check from a non-customer, but we have seen an increase in fraud from these transactions.

I am trying to get a feel for what others are doing regarding this situation?

My other question would be could we charge these folks a % of the check like a currency exchange? I don't believe that there would be a compliance issue, maybe a moral issue?

Any guidance here is helpful.

A check is a promise to pay from the payor to the payee. This is private contract. The payee made their deal with the payor, and no deal with the bank. If the bank refuses to cash or tries to add a fee, I return the check back to the payor with a dishonered check fee-usually $25.00.

Wrong - The bank made a deal with the account holder to honor the checks they write regardless the method a payee chooses to present the item for payment.

Where in the account agreement does it say "We will not honor checks you write to payees that are not customers of this bank if they come to the bank to negoiate them"

The banking industry made a deal with the world to to transact busines and hyped checks as an acceptable method of commerce.

By dishonoring checks presented at the counter the bank is illegally showing preference to creditors and can wind up with big time legal and regulatory problems.
