Procedures for Claims to Funds

Answered by:

Question:
We received a "Notice of Freeze" from the Florida Department of Revenue on one of our customers. Is there a set procedure for handling such notices from a state authority or do they differ by bank and or the state the bank or the customer is in? Would this procedure be the same for an action from a governmental entity as from a private action like an unpaid debt?
Answer:

Since every jurisdiction will have different requirements for the various types of garnishments, judgments, seizures, freezes, or whatever documents you may be served with, this is a question for your legal counsel familiar with Florida Law. They will also have to consider the applicability of U. S. Treasury Fiscal Service31 C.F.R. Part 212 Garnishment of Accounts Receiving Federal Benefits if the customer is receiving benefit payments.
