Do we need to give everyone who opens an account with us a Check 21 disclosure or do we give them only to customers that get checks returned with their statements?
Answer: 

You'll find the answer in section 229.57(b) of Reg CC. You must provide the disclosure to consumers who open accounts for which the consumer will receive paid checks enclosed with statements. Additionally, you will have to provide the disclosure to consumers who receive a substitute check in response to the consumer's request for a copy of a check (at the time of the request, if feasible, otherwise with the delivery of the substitute check) and those who receive a returned substitute check.
