If a bank's outside automated teller posts a deposit that includes stolen checks that are not made payable to the account holder's name, and the checks clear, thus laundered through the automated teller, for the benefit of the account holder, and the bank never monitors the checks, who is responsible for restitution of the funds stolen?

A lender approved a mortgage loan and did not gross up the customer's social security income, so for HMDA reporting, I used what the loan officer came up with in determining his income. Now, upon reviewing my quarter-end HMDA reporting, the HMDA compliance officer claims the social security income needs to be grossed-up and that I should change my HMDA LAR to reflect this change. Is this correct? I thought that I was to report my HMDA according to the data used to approve the loan application. Please clarify this for me.

Our customer had checks stolen, forged, and cashed at another financial institution. Since the other financial institution made final payment, can I return the checks to them on a "without entry" basis? Is my financial institution under obligation to reimburse its customer for the items that were cashed at the other financial institution?

How do you determine the difference between a "check card dispute" and "check card fraud?" If a customer claims he did not make the transaction, but the merchandise was shipped to his address, can we deny the claim? If a merchant verifies the security questions through Visa, and the transaction is approved, is the bank obligated to reimburse the customer?

If a customer had someone make counterfeit checks with his account number on them and then that unauthorized person used these checks to purchase items from a store that processed the check electronically, what are the time frames for customer reporting and the bank returning the item as well as required paperwork? It appears we are crossing from checks to Reg E and I am not sure what applies where.

I came across several checks while completing a forensic examination which had a blank or restrictive endorsement followed by a Prior Endorsement Guarantee (PEG) stamp. These checks were part of a forged endorsement of the true payee. They were deposited at the fraud perpetrator's depositary bank. Does the PEG stamp constitute a second endorsement? What liability, if any, exists between the depositary and the true payee for the use of this stamp on items containing forged endorsements?

We have a customer who deposited a counterfeit check and used some of the funds before the check was returned. She is overdrawn $1000. She is now saying that a certain check sequence has been forged. We looked at the items and they are not her signature. Let's say those are for $500. She wanted to fill out an affidavit of forgery. A co-worker will not give her one until she deposits the $500 that she owes us. I don't think that is correct. If she did't write the checks, she didn't write the checks. I do suspect that she is involved, but didn't know if we could refuse her an affidavit for the ones that appear to be forgeries.

We have a customer who sent a check for payment to a specific company. Company says they did not receive check, however, we found that check had been paid and endorsed by someone else not related to the payee company. Endorsement is not as drawn and not a forged endorsement. What course of action do we take for the customer?

Does the Federal Privacy Act prohibit a bank from verifying funds for another bank if a customer presents a check drawn on a customer's account?
