On Higher Priced Mortgage Loans, Does a bank need to escrow for taxes when the dwelling is a mobile home in a mobile home park that has the owners pay the taxes monthly?

The technical answer is yes, however if they don't own the land, why are they paying taxes on it?

Are they paying monthly taxes due on the MH they own or the land they don't own through a lease agreement?

Any taxes due on the MH then those taxes must be escrowed since the MH is their primary dwelling. Any tax they are paying on behalf of the land owner through a lease agreement would not have to be escrowed IMO.

That was what I was leaning to, but it always helps to have another opinion. I think the confusion comes in when we know that the monthly dues are going toward taxes, and perhaps are even labeled so by the mobile home park owners, but technically the money is being given to the owners to in turn go toward taxes.

In the state of New Mexico, property taxes are assesed on the mobile home, even when it is in a mobile home park and the land is not the mobile home owners property. You may need to see what your state laws say
