There is no universal requirement that a consumer has to opt into overdraft services. There is the Regulation E opt-in provision, but it covers only ATM and one-time debit card transactions. And there is the FDIC's 11/24/2010 Guidance that says the FDIC expects banks to allow customers to opt OUT of overdraft coverage for checks and other non Reg E transactions. There is the "best practice" to allow an opt-out from promoted overdraft programs in the 2005 interagency guidance.
