I'm curious what other TX banks are discussing pertaining to the recent passage of HB 910 which deletes the "concealed" language in the Texas statues dealing with how and when a handgun may be carried.

Do you currently have the §30.06 signage posted to restrict concealed handguns in your bank? Are you planning to post §30.07 signage to be able to point to if anyone tries to openly carry a gun into the bank?

I am curious as well. Also, I am trying to figure out if the wording for 30.06 has changed? I found one site that said the old signs would no longer be valid, but I can't find anywhere that shows a change to the existing wording.

We plan to post both signs in all of our Texas lobbies.

I understand from the recent TBA legislative tour that the wording will be slightly different, and you will have to post the 30.07 specific wording for it to be legal. I don't think the wording has been released yet.

I have an example 'notice' provided by TBA but it's condensed on one letter sized page. Confirmed through IBAT, this is the official language:

“Pursuant to Section 30.07, Penal Code (trespass by license holder with an openly carried handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a handgun that is carried openly.”

A peer bank is using the 30.06 sign from TASB (that's Texas Association of School Boards) that does a pretty good job streamlining the text to make both English and Spanish fit onto a 2' by 3' poster. I'm in discussion about the ability to customize this poster to our colors/watermark. Then we'll tackle 30.07 signage for 2016.

FWIW, I did a survey and some reconnaissance of several banks in our area and have found only one that currently displays compliant 30.06 signage. A handful of others have a bank-created sign asking that no weapons be brought onto the premises or the 'no guns' icon. I imagine things will change before January.

One more post - I just found the bill (HB 910) so I thought I'd link it for y'all and give you the language:

30.06 = "Pursuant to Section 30.06, Penal Code (trespass by license holder with a concealed handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a concealed handgun"

30.07 = "Pursuant to Section 30.07, Penal Code (trespass by license holder with an openly carried handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a handgun that is carried openly"

SECTION 53. Except as otherwise provided by this Act, this Act takes effect January 1, 2016.

While there are sections addressing various other topics, I think the signage changes and open-carry go into effect 1/1/2016.

No signs prohibiting concealed carry posted in our bank.

Are there any Forum readers who are employed with banks which have no intentions to post the signs?

One supposes that a new sign outlining the revised regulations having to do with prohibition of carry could be posted in anticipation of the changes in regulations. Like the 30.06 sign any new poster will have to meet state requirements in order to be considered a valid notification. Just any old poster won't do.

Do you know where the previous sign was obtained? Perhaps the supplier will have revised signage available soon.

We currently have a non-compliant 30.06 sign. However, we have discussed and are not going to post the 30.07 sign or a compliant 30.06 sign. We will allow open and conceal carry in the Bank by customers.

Bad guys will bring guns in if they want to anyways. Why stop the good guys from brining in their guns?

Because when one of the good guys opens up on the bad guys and kills an innocent by-stander, I can give you one guess on who is getting sued.

Banks would certainly never be sued if the bad guys themselves ran amok and killed an innocent with no armed good guys present.

Nah ... never.

One doesn't have to presume that the good guys are going to "open up" willy-nilly and kill anyone.

Only one opinion, but I'll take my chances with some armed good guys also present in the bank's lobby rather than armed bag guys only.

At any rate, it's up to the bank and the policy it adopts with respect to the signage it chooses to post. Liberty's a great thing. Liberty to have opportunity to carry, liberty to prohibit that opportunity if a business sees fit, and the customer's liberty to choose whether or not he likes the notion of the prohibition of carry by a business he may patronize.

Or you could be sued by a staff member whose PTSD, from previous robberies, gets triggered - because you allowed non-law enforcement individuals to bring guns in to their (your employees) workplace.

For those who decide to post the 30.07 notice, TBA has free downloadable copies on their website (of both the statutory notice and the optional "plain language" poster).
