We have a customer who has cargo trailers registered in the state of Ohio. According to the agencies I've contacted there, any trailer with a weight under 4,000lbs is registered but not titled. From what the state is telling me, since the trailers are not titled we have no way to place a lien against them with the state through the BMV/Title Office.

Before I proceeded with the loan I was hoping an Ohio lender could confirm that my only option for placing a lien against these trailers would be with a UCC? I was hoping to confirm because every state employee I spoke to was stumped by the question, so I wasn't super confident in the answers I received.

From what I have been able to determine, the information you received is correct. A UCC is the only way to go in that case.
