If a person brings in over $10,000 in cash that is being split between two loan payments, do we need to see if the Promissory Notes are for him and anyone else? In other words, if there is another person that is the borrower, are they receiving benefit of the cash loan payments and need a CTR Part I?

Same as a deposit to a joint account. Aggregation rules require that all individuals on whose behalf the transactions are conducted be included in Part I.

Yes, you would need to include anyone who benefits from the cash loan payments. So yes, you include co-borrowers on the CTR.

Thank you Brian and Adam. I received a copy of DDA sig card which was joint, and although it doesn't apply to the CTR transaction, it triggered the thought that I need to check the Promissory Notes to see if co-borrower(s).

Should cash payments to a loan be "payments" in section 25 on the CTR or a deposit to the loan? Or does it really even matter? I looked in the CTR Filing guide and and Q&A and it doesn't seem to be addressed or I am totally missing it.

It is not a deposit; it would be a payment.

Thank you for the response. My thought but having an issue with the system reporting is that way, so wanted to verify my thoughts before making an issue about it.

Customer brought in $15,500 to make loan payments. The total of the loan payments were $15,405.95. Do we just report the $15,500 cash in?

Cash in was $15,000 - cash out of $94.05 would not be reportable. $15,405.95 loan payment and $94.05 currency exchange.

Part I and Part III would have $15,500, but Part II would have $15,406 loan payment and $95 currency exchange as all numbers have to be rounded up. Part II will total out to $15,501, but that's okay.
