Mary Beth Guard is one of the four co-founders of BankersOnline and is now Editor Emeritus, after more than 16 years of serving as Executive Editor. She was instrumental in the creation and expansion of BankersOnline, as well as the launch more than a decade ago of BOL Conferences, Inc. and its continued operation and growth. Mary Beth is also the director of BankCompliance.com, the subscription-based compliance service now being offered online. Also, Mary Beth serves as CEO of Glia Group, Inc., which produces BOL Learning Connect. For nearly four decades, Mary Beth has utilized her background as an attorney to focus on banking industry issues, first as general counsel for the Oklahoma State Banking Department, then as general counsel for the Oklahoma Bankers Association, prior to her work with BankersOnline.

We are trying to establish a 5 point customer verification process. What are other financial institutions using? I've been told that it is not recommended to simply use social security and driver's license numbers as they are too easy to obtain on the internet.

Can a bank give a $100 bonus for opening a noninterest bearing account? Reg. Q prohibits interest paid on DDA, but Reg. DD defines a bonus as an award...given for opening an account as being outside the scope of interest.

We are in process of writing a privacy policy, and have a question. The one that we are using as an example states " at the time a consumer approaches the bank to obtain prequalifying information for a product or service, or opens an account, requests a loan, or transacts a banking service, the initial consumer data protection and privacy notice will be provided. At that time, each consumer will be required to acknowledge that he or she received a copy of the initial notice." What we are afraid of, is that this is saying that anytime someone comes into the bank to purchase a cashiers check, cash a check drawn on one of our customers accounts, we are going to have to give a notice or keep some type of log. We are wondering if this statement is something that could be omitted in its entirety, since it refers to a consumer.

I would like some info on Corporations using an Assumed name to do business. Do you let them deposit checks payable only to the assumed name or the Corp. name or both. Does it matter? What is the liability from a legal standpoint? Account ownership, bankruptcy, know your customer, extended due diligence?

What is the proper way to set up an account for donations to assist a family whose home was destroyed by fire? Who should sign on the account, what tax identification number should be used, and how should the account be titled?

We are considering the creation of a Web page and the offering of electronic banking services to our customers. Do you have any guidelines or a checklist of the items we should be taking into consideration? I am concerned that we are overlooking some basic items as we move into this new type of products.

At my institution, we presently require the copying of all identification used in opening an account and closing a loan for a non-customer. This includes a driver's license. Are we infringing on anyone's rights by doing this?
