Custodial Savings-Minor Cash In When of Age?

Answered by:

Question:
On a custodial savings account, can the minor cash in when they are considered of age (18 or 21) or must the custodian cash in and then give to the minor?
Answer:

It is the responsibility of the custodian to turn the money over to the minor. A bank should never disburse money to anyone other than the custodian. If the custodian refuses to disburse the money, then the former minor can take the custodian to court and get a court ordered release of the funds. The age at which this will happen and the process that the minor has to undertake is based solely on State law.
