In developing a esignature process for consumer closed-end loans with a goal to transfer the paper, are we required to comply with both the ESIGN Act and the UETA?
Answer: 

State UETAs are fine for e-signatures and contract documents, but don't meet minimum standards for federal disclosures. That makes them a good choice for commercial loans, but not consumer. ESIGN is universal and will satisfy both state and federal requirements.
