Can it be claimed by the consumer, I always say yes. The next question is what is required of the bank. A very brief investigation by the bank may deduce that the consumer did not volunteer financial information and the consumer themselves completed the transaction. They were misinformed and gullible but under no physical threat. They could easily have contacted law enforcement if they felt threatened. I would then deny the claim. That way the bank did not refuse a potentially valid claim and it reviewed its own records which in concert with the consumer's statement justify the claim denial.
