If the account is an IOLTA account under New Jersey bar regulations, there is a requirement that a bank holding such an account must agree with IOLTA Fund of the Bar of New Jersey to report an overdraft in the account. The IOLTA Fund's Guidelines for Financial Institutions indicates that to hold IOLTA accounts, a bank must contact the Bar of New Jersey's Office of Attorney Ethics to request a Trust Account Overdraft Notification Agreement.
If your bank has signed such an agreement, it should have a copy on file, and information on how to make the notification is very likely to be included in the agreement.
