Answer:
Demonstrable consent is the process whereby the bank explains how it will make electronic disclosures and how the customer must demonstrate that they can receive and react to them. And if the customer fails to complete the process, it means the bank would not have made the required disclosures. Further, technically the bank cannot make e-disclosures until E-SIGN and demonstrable consent are in place.
