Question: 
We were told that the Supreme Court determined several years ago that Section 8 of RESPA is unenforceable?
Answer: 

On May 24, 2012 Justice Scalia delivered the opinion of the Court that in order to establish a violation of Section 8(b), which deals with unlawful splits of fees, a plaintiff must demonstrate that a charge for settlement services was divided between two or more persons. This case did not impact Section 8(a), which deals with kickbacks.
