Using a Credit Report Pulled by a Mortgage Company

Answered by:

Question:
I work for a financial institution and individuals are referred to us by mortgage companies to get construction loans. Is it acceptable to use a credit report pulled by the mortgage company?
Answer:

I have seen mortgage companies transfer files and that included credit reports. My own hesitation exists because when I comply with the FCRA I want to know that I have a contract with the credit reporting agency and they will answer to me if I have a question or complaint. I believe it is "cleaner" when this line of responsibility is drawn. I also believe that the CRAs would have issues with the use of someone else's report. It is very possible that the contract between the lender and CRA may address what can and cannot be done. That should be the first step or reference.
