Web Site Transactions, Disclosure, and Recordkeeping

Question: 
Is the information we receive and the records we maintain from customers who utilize our Web site to make transactions subject to the same rules and regulations regarding disclosure and being subject to subpoenas and requests for records?

Yes. This could all be used as evidence in a court case as it would relate to the customers transactions and account history. E-mail records off of PCs, servers and backup files has been used in court cases already. You should have established retention policies in place.

Absolutely! The protections for customer information are not based on the process, location, or medium at or through which you obtained the information.
