At last week's ABA conference, the first question asked at the regulator's breakout session (of the OCC) was whether or not the OCC was going to monitor ADA and COPPA compliance. The reply was that they do not have enforcement authority over ADA (which doesn't mean it should be ignored) but that COPPA checklists were being authored now.
I still put these in the category of sleepers. Watch out for them. And since the OCC's site has been revamped for ADA compliance, as per government requirements, I am waiting for the next shoe to fall. It probably won't be from the government but it will come in the form of a civil suit. AOL was sued for its programs and accessibility and banks were sued for ATM access. This is a natural progression.
