I understand that Florida will share the phone numbers on its existing state no call list with the national registry, but will also maintain its own state-specific do not call list.

Does this mean that a seller calling Florida residents only needs to check the national or state list since the same numbers will be on each?

The Florida do not call site does not have details. Any Florida based compliance folks know the scoop? For example, can one simply rely on the national DNC registry for Florida residents?

I would think the National DNC registry would "trump" the Florida DNC registry.

In addition any out of state telemarketers soliciting in the State of Florida, should know to check the Florida registry, IMHO.

Florida do not call law does not apply to financial institutions, insurance, broker dealers. Anyone disagree?

I agree, however I believe that you still have to register with the State in order to telemarket even if you are one of those exempt entities.

I'm hoping that Fl does not require an exempt entity to register. Do you have a law cite that we could use to determine this?

FL Statutes Title XXXIII Chapter 501.608 (b) - "Any commercial telephone seller claiming to be exempt from the act under s. 501.604 must file with the department notarized affidavit of exemption."

The actual law exempting these businesses states (s.501.604): "The provisions of this part, EXCEPT ss.501.608 and 501.616(6) and (7) do not apply to:"

I posted a question earlier today and maybe you can help answer it. Other than the Do Not Call Registry, do you know of any new Florida law that went into effect 2/1/04 that prohibits a financial institution (credit card collections to be specific) from calling a "restricted" phone number? The cardholder gave us the number to begin with. I think she's confused about the Do Not Call Registry.
