If a customer presents a counterfeit cashiers check from another bank can we confiscate the check? Also, is anybody filing a SAR when they receive a counterfeit cashier's check? Considering the fact that the customer may not have any idea that it's counterfeit is it advisable to file a SAR? I think I would only file if I thought they were involved. Any thoughts appreciated.

Becuase the check is payable to your customer, it legally belongs to them. I will often ask if they will permit me to keep the item as I use them for training my front line staff, or at the very least take a photocopy.
Also, since my customer is the intended victim, not the criminal, I consider my suspect unknown and only file if the dollar amount exceeds $25,000.00.
