We allow all customers a set limit for overdraft privilege. We do not have any type of written agreement with the customer in regards to the overdraft privilege. If a customer abuses the account and we need to stop the overdraft privilege must we send a notice thirty days in advance or can we just stop it today?

"Overdraft privilege" is a term promulgated by one of the vendors of overdraft services. Your use of the term implies that you promote overdrafts and, therefor, do have a responsibility to make certain disclosures to the consumer.

Regardless, you are not required to give advance notice of the consumer's ejection from either a promoted or an ad hoc overdraft service. You never promised that you were going to pay their NSF items anyway and you are certainly not obligated to do so.
