We took a property into ORE last year and sold it this year. The borrower signed over the deed in lieu of foreclosure. In the agreement, the bank waived it's rights to pursue a judgement for the deficiency.

This doe not mean, however, that we do not need to complete a 1009-C.......correct?

Correct and you should have filed last year.
