Are we violating Reg DD for New Account if we are to charge a monthly service charge and maintenance fee before 30 days up? We opened a business checking and it is constantly on NSF reports so it is still considered as New Account but we decided charge a Fee. Is there any regulation for 30 day new account? Thanks.

Regulation DD does not apply to business accounts:

Sec. 230.2 Definitions.

For purposes of this part, the following definitions apply:

(a) Account means a deposit account at a depository institution that is held by or offered to a consumer.

This is purely a contractual issue.
