Nebraska Bankers Association may be able to help if you want specifics for your type of bank. State banks can contact the Nebraska Department of Banking and Finance and visit with an examiner. If you are just uncertain as to the rule and don't need to cite a law, I'll share our practice which has never been an issue. Basically, you can charge the garnishment fee as long as there are sufficient funds to do so and, of course, you do not use the new protected funds. We do not charge the fee unless we can also set aside funds for the garnishment. The fee is only charged once per ganrishment request - not per account garnished.
