Hello,

I have a member that is disputing a deposit that he made two years ago stating the check in his ATM deposit never posted to his account. Does anyone know the statute of limitations on ATM deposit disputes? Since it is a "check" deposit, it is not covered under Reg E -- so I don't think the 60 days from the statement date applies.

If he's complaining about the check not posting to his other account, it's a UCC question. The paying bank can elect to refuse payment if it's over 6 months old. If the check shows up two years after the fact, perhaps in image form, it could be dishonored.

Pulling people out of the ditc...
You may want to also look at your deposit contract and see what you tell the customers for disputes of this nature.
