Hi there,

The President of my bank told me that she heard effective 7/5, all smoking areas has to be 100 feet from the building. I had heard that effective 7/5, all restaurants and bars were going smoke free. I don't know anything about 100 feet from a building. Does anyone know anything about this?

I appreciate your responses. Thank you.

100 feet from the office? I have not heard or read anything about that. That would be impossible to enforce. Are they going to equip police officers with measuring tapes. LOL Furthermore, if you work in Boston, you would have to smoke on the common to be satisfy this requirement.

I reviewed the new law, and I see nothing in it about the outside areas surrounding a workplace. It's possible a given employer might designate its private property within that radius a smoke-free zone to prevent employees from loitering outside the door (it's so attractive to see that!). I suppose individual cities and towns might have separate health regulations or local ordinances that would apply.

A copy of the law is available HERE.

It applies to ALL places of work, regardless of the number of employees, with certain exceptions (based on type of workplace).

Perhaps that was the distance that he thought would satisfy the provision that an outdoor space could be considered an indoor space. If the spaces were adjacent and windows and doors of the indoor space were open, then the outdoor space becomes an enclosed space too (smoking prohibited). I'm all for it. There's nothing like walking through a haze of smoke to enter the local movie theatre.
