We have a check that is payable to: Jane Doe, Individually and as Guardian of Janice Doe and Johnny Doe.

What type of endorsement do we need?
Can the check be deposited into the personal account of Jane Doe?

With the and in there it makes me think there is a tie to his role as Guardian and should be negotiated as such

I just would just flat refuse to accept the check. Either money belongs to the Jane or the kids - it cannot belong to both.

Once the payee endorses the check both ways it's a bearer instrument and there is no real restriction on where it goes.

Regardless, I would not accept it unless I had the children's fiduciary accounts. After he had endorsed the item both ways, I would accept it for deposit into those accounts. If he is due some of the monies, he can withdraw them.

I want a paper trail...
