Is anyone aware of a requirement that you provide a user of the bank's ACH debit or credit systems with a copy of the NACHA rules or can you refer them to the rules at the bank? The customer is bound by many of the requirements and while some are set forth in the ACH agreement--many are not. The rules books get pricey (about $25) and often confuse customers; still, many sample ACH agreements attest that the customer has actually received the rules (and that the bank will update those rules--doubt many do). Is this ACH rule book being given to the customer required or just helpful or not a good idea at all?

There is no requirement that you provide the NACHA rules to your customers. However, you do want to be sure that there is a statement in your ACH agreement with your business customers who originate ACH transactions that they will abide by the NACHA rules. Whether your provide the rules to them, or they obtain them themselves, this statement should be in the agreement.

Our insitutions provide a copy of the Corporate Rules Book to all corporate customers when we begin originating for them. Our agreements contain language that states that the client "has received a copy of these rules and will abide by them as they are updated from time to time". On an annual basis, we send a mailing to all of our corporate originators, informing them that the rules have been updated and we enclose a copy of UMACHA's order form. It's up to the client to get updated copies.

Your customers can also go out to the website nacha.org to get information as well

You can get the NACHA Rules online which you print the information for your customers. You only need to give any updates after the intial disclosure is given when the service is first incurred. That's my take on your question.

We give new cash management customers a copy of the Corporate Rule Book as well. We provide info about how to get updates and new books (from NACHA) and reference the requirement to be in compliance with NACHA rules in our contract.
