There is some confusion at my bank about when the written notice of the final results of the investigation should be sent to the consumer. It is my opinion that if an error occurred, the letter the Bank uses (to state the results and that provisional credit is final) should be sent within three business days from the date of final resolution. There is some disagreement on that and I am being told that the Bank should wait to send the letter (up to the 45 days even if resolved earlier) in case the merchant disputes it. Reading the regulation, this doesn't sound right to me? Does it make a difference if they call instead of a letter within 3 business days and to inform them of the results and that provisional credit is final?

This Related thread discusses in detail when to consider an investigation "concluded" to start the three business day notification clock.

If we conclude an error did occur we can notify within 3 business days orally or in writing. If we conclude an error did not occur, we must notify in writing.

Lastly, if this is a point of sale debit card transaction, remember that we can take up to 90 days to complete our investigation if needed.
