We are thinking about opening a DPO and I am unable to find a clear answer on whether or not we can have an ATM at a DPO location. Can someone please provide some guidance on this?

Might depend on what type of organization you are and where you are located - National Bank, State Bank, State law, etc. Normally, you can put an ATM wherever you want to however.

We are a state bank. My concern is where it states, "may only solicit deposits....does not receive deposits, pay withdrawals, or make loans" because an ATM can receive deposits and make withdrawals.

We are in Texas and I am looking at 7 TEXAS Admin.Code 3.93.

An interesting question in Texas. I cannot locate any guidance. It might be the same as TN or it might not be: https://www.tn.gov/tdfi/bank-trust/banking/bank-bulletins/bulletin-b-05-4.html

Neither are considered a branch office in TX and whether combining the two would not be allowed is probably a question for the Department of Banking.
