Hi, we have a difference of opinion so looking to you for insight, please.

Marital property state. One applicant spouse applied and approved for loan and the non-applicant spouse is currently alone on title. Do we either need to add the applicant spouse to title or the non-applicant spouse to the loan? Or is this situation perfectly fine in a marital property state as long as both spouses execute the mortgage? My belief is this is perfectly fine as long as both execute the mortgage.

So, let's say the wife applied alone and qualifies for credit, but in order to make the loan the husband has to also be on the legal obligation for repayment (note).

That, my friend, is the original basis for Regulation B.

You qualify the actual applicant(s) that apply for credit and figure out who you need to sign the security agreement to gain access to your collateral.
