The contract with our flood determination provider states that if the property has a dual zone, they will state that fact under the comment section of the determination form, and put the special flood hazard zone on the form. If there is more than one building on the property(in different zones), they do not list each property individually and indicate the flood hazard zone for each. The contract and the procedures for completing the form seem to be out of compliance with the instructions for completion of the flood hazard determination forms in FEMA's yellow book. Appendix 6 of the Flood Insurance Guidelines book, page 6-3 has the following instructions for MULTIPLE BUILDINGS: "If the loan collateral includes more than one building, a schedule for the additional building(s)/mobile home(s) indicating the determination for each may be attached. Otherwise, a separate form must be completed for each building or mobile home. Any attachment(s) should be noted in the comment section. A separate flood insurance policy is required for each building or mobile home." It seems to me that the contract contradicts FEMA's instructions for completing the Standard Flood Hazard Determination Form. Not to mention that we are not getting a determination for each building. Would the contract be in violation?

Why not contact your flood determination company and ask them this same question. If you aren't satisfied with their reply, there are numerous other flood determination companies that would appreciate your business.

I haven't found the actual document to which you refer, but the same language is used in this 1995 FDIC document, towards the bottom under "other information":

Unless this procedure has been updated or modified in the intervening years, your flood zone determination service is non-compliant.

Not to mention that they are depriving themselves of the opportunity to sell multiple flood certs.
