Good morning all! I am having some confusion here, as usual. There is a loan with a purpose of refinancing a HECL to permanent and secured by a home. I am thinking that this would be HMDA, but one of our loan assistants thinks that it isn't. I thought I would ask some of you here what you think. Also, has anyone seen Dawnie lately?? I haven't seen her online recently and I was just a little worried. Thanks for your help ahead of time! Have a great weekend!

It sounds like you are refinancing a HELOC into a permanent closed-end loan. If so and both obligations are secured by mortgages, it would be considered to be a refinance and reported as such.

Len is correct. The loan meets the definition of a refinancing and since you are refinancing into a closed-end loan you lose your optional reporting exception.

Dawnie just had a new baby boy, so she probably will be MIA for a while.
