I am trying to put together a Facsimile Signature Hold Harmless Agreement which can be used for personal account holders. In doing a BOL Thread search I found some assistance and even some language provided by Andy Z to get me started. (Post #328927). Does anyone else have an agreement in place they would be willing to share? Also, I assume that the customer has to manually sign the Hold Harmless Agreement and the facsimile signature is not acceptable on the agreement. Is that correct?

You are correct that the facsimile signature could not be used to sign the agreement, but you should have a sample of the stamp on the agreement.
Sorry, we don't have such an agreement yet, on my list of things to do too!

As the law already makes the customer responsible for the use of the facsimile signature, I suggest you refrain from calling it an agreement - his agreement isn't necessary, it's just the way things are. Call it a disclosure.

Before you take this step, look at your signature card. It's pretty common that modern signature cards address facsimile signatures. If you feel its necessary to enhance any language you find there, be certain the language in your separate disclosure is consistent with that in the contract.

Do you allow use of the facsimile stamp to endorse a check to cash? Customer is not in front of us, but spoke with the officer of account and stated he was sending his wife and she endorsed under his stamp.
