My bank's mortgage originators (not a subsidiary or affiliate) take applications and submit them through desktop underwriter. I would be interested to know if there are any others doing the same and if you report denials and approvals on your bank's HMDA-LAR or does the investor report them?

Our mortgage originators do both in-house and secondary market loans. The loans for the secondary market are reported by the investor since they make the credit decisions. The loans for in-house are reported for the bank.

I assume you are talking about loans done through Fannie Mae's Desktop Underwriter. We also do secondary market loans through DU, which are then sold to Fannie Mae. Are you telling me that Fannie Mae is responsible for filing a HMDA report for those loans?

This is how we've been instructed. If we make the credit decision...we report...if another investor makes the decision...they report.

We don't use DU, but we use LP thru Freddie. It's my understanding that LP does not approve or deny the loan, it only tells you if the loan is elgible for sale to Freddie and the degree of documetation you have to provide based on the acceptance level. I'm not sure if DU works the same way or not.

We make the final decision and report the loans on our LAR, and when we sell them to Freddie I assume they report them as purchased loans.

We use DU and originate Fannie Loans and we complete the HMDA for those loans. See HMDA Getting It Right page A-15

E. Type of Purchaser
1. Enter the applicable code to indicate whether a loan that your institution originated or sold to a secondary market entity within the same calendar year:
0 - Loan was not originated or was not sold in calendar year covered by register
1 - FNMA (Federal National Mortgage Association)
2 - GNMA (Government National Mortgage Association)
3 -
etc.

We also use DU where the branch originator takes app., submits to DU, and then the originator receives a decision. I'm told that we are not making the credit decision. Would I report this for HMDA? I'm thinking no since the originator is not making the decision.
Please help!

If this helps any I looked at the DU form that is returned to the bank and it says recommendation: Approve/Eligible.
Your help would be greatly appreciated as we are trying to make a decision on this.

We use Fannie Mae's DU and report our loans as originations that are sold to Fannie Mae. I agree with a previous poster that DU only determines whether the loan is eligible for sale to Fannie Mae, it does not approve or deny the origination of a loan.

Also, can anyone confirm whether Fannie and Freddie file HMDA reports? I'd be surprised if they do.

We use Fannie Mae's DU to originate and then sell to Fannie Mae. Different variations of "brokered" loan situations are described in the HMDA-GIR manual (I think that's where I read it), but since this was still unclear, I called our FNMA rep quite a while ago to find out if we should report these loans or they should. He confirmed that our bank should report them, so that's what we've been doing for years. We've had two OCC exams where this hasn't even been questioned, so it must be right....

Roger, we use DU and report all originations and denials. All DU says is whether or not they'll buy it from you, you make the decision whether or not to do the loan.
