We have a cusotmer that wants us to raise his debit card limits to a very high daily amount. I've told the Private Banking Manager that we are responsible for unauthorized withdrawals and may not always have chargeback rights and could end up sustaining a substantial loss if fraud were to occur on the card. He wants us to have the customer sign a release, releasing us from any liability above our normal established limits. Can we do this?

I do not believe it would be enforceable. I do not believe the customer can waive their right under the act.

hhughes is correct. Reg E does not allow the bank to push liability to the customer.
