#90089 - 06/20/03 01:08 PM The 2000 Census changed my AA.

The 2000 Census turned a tract in my assessment area from Middle to Moderate. That tract is on the fringes of our AA. The adjacent community (which is not in my AA) is also Moderate. Must I amend my AA to INCLUDE that other community, or can I leave my AA alone? Help

Without knowing how your current AA is configured... whole MSA, whole county, a few census tracts, etc., it is difficult to answer your questions.

However, you may adjust the boundaries of your AA so as to include only the portion of a political subdivision that you reasonably expect to serve. The regulators allow financial institutions some flexibility in designating their assessment areas, particularly in the case of an area that would otherwise be extremely large, of an unusual configuration, or divided by a significant geographic barrier (lake, desert, etc.). Your assessment area(s) must consist of whole geographies (census tracts); may not reflect illegal discrimination; and may not arbitrarily exclude low- or moderate-income geographies (census tracts).

If the only change to your existing AA was that a census tract changed from middle-income to moderate-income, and you do not normally serve the adjacent moderate-income city, then you probably do not need to make any changes to your AA. If you do serve the adjacent moderate-income city, then you may want to consider adding it to your assessement area.

Fuzzy is right on - your AA is driven by your lending area, not by c-tract income designations. No reason to change your AA due to changes in income categories of c-tracts.

While the adjacent community is not in your AA is the bank making loans there? For example if there are loan originations in middle and upper income tracts in that community and none in the LMI tract which are adjacent to the existing AA, you may be asked by regulators why that would be. There may be nothing wrong at all in excluding the adjacent community, just review your lending patterns as you don't want to raise an exclusionary flag.

When the FFIEC publishes the official census tract income classifications, check to see if its still a moderate classified tract.

I have been waiting for the FFIEC official designation of low and moderate CTs. Where are you all looking for tract designations of low and moderate ?

You can manually calculate them using 2000 census data.

You can get the low-mod info for individual addresses with this process:

1) Go to http://www.ffiec.gov/geocode/default.htm
2) Enter an address to geocode. If the address is found, you will see some additional options.
3) Choose "Get Census Demographic".

Personally, I prefer a higher level of automation and technology.

The FFIEC recently released that information. Look at FFIEC Census Reports . From there you can pull up the information by MA or county.

For example, to get the information on each census tract in a county, select the State and then Retrieve by County. This then gives you a list of counties which you can select from. Select the county you want and then Get Census Demographic. This shows the census tracts in the county and whether census tract is a Low, Moderate, Middle or High income area.

Why is it that this poster "CarlD" is always trying to get a plug directly or indirectly in for his company. From what I understand, he has never been a banker or regulator. He has no clue. CarlD take your baseball and go home!!!!!!!

I went back over Carl's last 10 or 12 posts just to be sure of what I want to say. In only one of those posts I reviewed did he make any even vague reference to his product, and that was the post in this thread. Even there, I'd be hard pressed to say it was a plug for his company - he just said he'd prefer a more automated process. That could mean Don Narup's product for all we know. While I think that Carl was a little aggressive in pushing his company in early posts on this forum, lately he has toned it down quite a bit. I, for one, think he is making a valuable contribution to the dialog here and want him to know he has my support and from my perspective, I'd like him to stay around.

I also think it's someone incongruous to be taking shots at someone from behind the mask of anonymity.
