Need Separate Trust Papers for Testamentary Trust?

Answered by:

Question:
Our customer's mother passed away. He is wanting to open a testamentary trust in his name per the deceased will. Do we need separate trust papers for the testamentary trust or just the ss-4 showing he filed for a tax id number?
Answer:

The terms of the trust are set out in the will. You will need to have proof that the Probate Court has approved the will and trust and that it has agreed to the appointment of the designated trustee. You will also need the EIN for the trust.
