A member used a debit card to make a purchase. Merchandise was delivered and merchant has photo proof it was left on the customer's doorstep. Customer also admits to seeing package being stolen via video feed.

No Reg E dispute since it was an authorized transaction. Does customer have a Visa dispute condition for undelivered merchandise? Is the photo of the merchandise on the customer's doorstep and customer's admission they saw the package being stolen from the doorsteop considered "compelling evidence" that the package was indeed delivered? Trying to avoid the cost of a chargeback/possible arbitration if customer doesn't have dispute that could win.

Not an expert in this, so I won't opine on the Visa dispute. To me, it sounds like your customer should be filing a report with the police and not a dispute with you or Visa. That's why most delivery services now take pictures of your delivery at your doorstep, to prevent these kind of claims.

I would absolutely not process this chargeback. The condition for 13.1 reads: The Cardholder participated in the Transaction but the Cardholder or an authorized person did not receive the merchandise or services because the Merchant or Load Partner was unwilling or unable to provide the merchandise or services.

Not only was the merchant willing and able, they DID provide the merchandise.

Visa only protects a cardholder with respect to a stolen package if the original purchase agreement required signature delivery and the merchant failed to ship with merchandise with a signature delivery resulting in the theft, or the card holder purchased shipping insurance which the merchant failed to include on the package resulting in a loss to the customer.

Absent either of these factors, your customer is out of luck.
