This is probably going to be a silly post, but I have been asked a question. Apparently, our head of retail states it's up to the manager's discretion on whether or not to get proof of a legal name change (i.e. marriage, divorce, adoption, etc.). What does your bank do? I believe we should have proof, but want some back up.

I assume you have a situation where the desired name does not match their ID such as a driver's license. For a new account it seems it would be difficult to comply with the CIP rules without some proof.

This is an existing account, but the individual involved has gotten married. Do you require proof of the name change (marriage license, updated ID, etc.)?

We require a copy of the marriage license or documentation of whatever occurred to change the name of the customer before we change the name on an account. For those newly married, it would be a good time to remind them that they need to change the name on their Social Security number as well.

Skittles, we require proof of all name changes and the reasons. Most of the time it's either a marriage or divorce and we always require back-up documentation before making the change and we actually retain the docs in Ops as proof.

We require legal docs, whether it's an ID, marriage certificate, divorce decree, or other types. A copy is filed with the original and the new signature card.

We required the marraige cert or divorce papers AND a copy of their new ID. If they don't have ID with the new name on it, we figure people hopefully won't take their checks or cards. We also require that we have a valid DL# on our system. In Washington State (where I am) If your name changes then your Driver's license number changes too.

We have the same scenerio right now; we have an existing account and the individual involved has gotten married. Based on everyone's replies in this thread it appears there is not a Federal requirement to get proof of the name change (marriage license, updated ID, etc.) and that it can be left up to the banks descretion whether or not to get anything.

Is that correct?

Yes, that is correct. You should always docement why you changed something on an account whether it be a name, adress, phone no, etc. If for no other reason, do it simply to cover yourself should it be questioned. First rule of thumb that I learned in banking is to always cover yourself!!!! Never just take a customers word for it.

We require a copy of the legal papers along with a current driver's license with the new name. We won't do any transactions without it.
