Under the The Servicemembers Civil Relief Act (SCRA), (50 U.S.C. § 4026), it states that under "Availability of non-business assets to satisfy obligations" that If the trade or business (without regard to the form in which such trade or business is carried out) of a servicemember has an obligation or liability for which the servicemember is personally liable, the assets of the servicemember not held in connection with the trade or business may not be available for satisfaction of the obligation or liability during the servicemember’s military service.
Do the "assets of the servicemember not held in connection with the trade or business" include a personal guarantee of the servicemember?

Does any regulation require an institution to send a reduced rate letter when adjusting the rate due to an SCRA claim on a loan?

Other than the specific fees listed in 232.4(c)(1)(i)-(iii), do we have to add fees into the MAPR calculation that would otherwise be excluded from the finance charge? For instance, for a vehicle title loan fees excluded under 1026.4(e)(1) or for a land only loan fees excluded under 1026.4(c)(7)?

Under the Military Lending Act, it states that a Consumer Credit Loan that is "Subject to a finance charge OR Payable by a written agreement in more than four installments." My question is whether a 6 month term loan for $2500.00
would be exempt?

If our borrower hasn’t requested SCRA protection and is past due on the mortgage, can we start foreclosure foreclose as we normally would?

Are banks required to send the SCRA notice out to all delinquent residential mortgage customers that are 45 days delinquent or just those that have filled out the SCRA form stating that they are in the service.

This question pertains to SCRA. From how I understand the act, it pertains to Federal guidelines for Service Members. I am trying to understand the state specific guidelines that would give the Service Members additional benefits. Is there a centralized website or a guide that would provide SCRA specific state benefits for all of the states?
