On real estate transactions, would fees such as title insurance that are normally not included in the APR need to be included in the APR prepaid finance charges if they are paid to a broker or a broker's affiliate and an affiliated business disclosure provided?

I am very confused about pre-approvals when it comes to HMDA reporting. My bank doesn't technically have a pre-approval program. We will occasionally give a written a pre-approval letter to a borrower if they insist on it, but even then many times the property is identified making it more like a pre-qualify. Should we ever enter a 1 or 2 in the pre-approval section of the LAR?

When you take a Deed of Trust as abundance of caution, is it customary to record the deed and get title insurance as well? In my opinion, if you are going to record and get title insurance, is it really abundance of caution?

Does this situation fall within the purview of disclosure, and if, so, exactly what charges for services have to be disclosed?

Our bank is considering implementing a loan document preparation fee. Other than making sure these fees are disclosed as a part of the finance charge, are there any other pitfalls or disclosure issues we need to be aware of and address? We would charge the fee on new originations only.

Our bank is considering providing an employee benefit which would reduce the closing fees when they finance a new home purchase or refinance their existing first mortgage. In particular, we are questioning whether the bank can pay for the outside costs such as attorney costs for title search and title insurance, appraisal fees, and etc. (for employees only) without violating any regulations.
