SAR - Work at Home Scam
06/08/2009
A customer of our bank is a victim of the work at home scam. The customer cashed the checks and spent the funds, now the checks are being returned as fraudulent. The customer is taking an unsecured loan for the amount they owe. Do we consider this a loss at this time on the SAR or because they are taking a loan would we treat it as though no loss would occur at this time? If the loan defaults, would we need to do a correction of the filed SAR to report the loss?

A Very Sticky Family Situation
06/01/2009
Two checks for $20,000.00 were deposited to a relative's account without endorsement of the payee. The money from the deposit was diverted to a mutual fund by the person who made the original deposit. If we go back to the issuing bank and sign an affidavit of forgery, will the bank that took the checks for deposit try to recover from all persons named on the account? Are all account holders liable for the actions of one of the account holders? This is a very sticky family situation.
