Does the consumer have any liability for negligence for unauthorized ATM transactions if they readily disclose their PIN with the card? It was my understanding that even if the consumer wrote the PIN on the card envelope and the card was stolen, they are still not liable for negligence if we are notified within the required REG E timeframe. Is this correct?

As more and more business customers rely on e-mail, should the bank wire departments accept wire requests (scanned from the banks wire form) via e-mail?

We are considering requiring our employees to only receive their statements via e-mail instead of print. Is there anything in the Regs that would prevent us from being able to do this since our employees are provided email access through the bank and can receive it there? Are we required to give them a choice of delivery method for their statement if this is available?

We have an employee who suggested using a freeware instant messaging software running over our T1 line. Are there risks here we should resist?

We recently had a network assessment completed. The vendor recommended that we do "periodic" background and credit checks on employees who have access to sensitive information. Besides the IT staff, who else would you recommend we include in this "periodic" check and how often should it be done? We thought annually, would be that be sufficient?

A mortgage company has approached our bank wanting to pay a specific employee a referral fee, if we would forward real estate loan applications we have turned down to them. I do not see how this is a legal process given Section 8 of RESPA's prohibition of referral fees. The only way I can see it would be legal, is if forwarding the application to the mortgage company would not be defined as a settlement service. I think it would be.

While digital signatures are being tested and used for new applications, the old handwritten signature is still what most of us rely on for identity.
