We have a customer that is highly disabled and unable to take care of herself without outside help. She needed cash and gave her ATM card to this person along with the PIN so that she could get cash. The helper withdrew unauthorized additional funds. Our customer filed dispute with us. My questions are we released from giving her funds back since she gave the PIN? Also, can we make her file a police report and press charges against the person or we'll withhold her funds?

Looking for standards as they may apply to primary doors going into a branch office. I base the primary door used as the one most visible. Other doors such as rear or side doors should not be used except for emergency.

Are we required to return funds for an unauthorized ATM withdrawal when the customer admits to have given authorization for the same person to use the card previously?

One of our customer's debit cards was used as an ATM debit by another family member. Evidently, the customer gave the family member the PIN number for it to work, although the customer said they did not give them permission to use the card. What is our liability?

I read some comments regarding bait money on the BOL web site. I agree with the logic, but I have another question. It was stated that we should replace one security measure with another (for example, trade the bait money for better cameras). Are there any statistics on how helpful the other measures are in preventing bank robbers or in catching them? Do you know where I can get such statistics?

A mother gives a son her ATM card and her PIN to use. The son and his wife steal the card a week later and over the weekend withdraw $951.00 from the mother's account. The brother, who is not on the account calls to report the card lost and the card is placed on hot card status. The CSR is a neighbor and insists we give her money back immediately. Does the bank have any basis for not returning the money when according to REG E it was reported within the time frame? Is there any way that we can use the fact that we were told that the mother had previously given the son her card and number? Where can I find more information concerning the liability of the bank in such cases?
