We have four branches located within a close range of each other but in two different states. We would like to market our loan origination fees for one state differently (lower) from the loan origination fees for the other state due to competitive reasons. Are there any discrimination or UDAAP issues with this?

I have a question about Verification of Employment/Deposit fees. We have a few employers who charge a fee for this verification. Where should the fees be listed on the GFE?

If a customer makes a deposit to a charged off checking or savings account and it brings that account to a small positive balance, is the bank allowed to service charge that accounts balance?

A customer used her debit card to rent a car. She decided to not purchase car insurance for her rental, which then got stolen. The rental agency has charged her debit card for over $3,000. She has now filed a dispute claiming she did not authorize the car rental agency to process that charge. Does the bank have to take that liability?

On August 3rd a mistake was found by our accounting department that occurred during conversion in March. 42K of legitimate signature and PIN based debit card transactions occurred during this time that the bank failed to debit customer accounts for. The bank paid the network (STAR) that paid the gas station for the transactions. However, the bank did not debit the customer accounts for the purchases to clear the transactions. Can we, at almost 6 months later charge the customers? I feel we can but we also need to consider possible customer effects of NSF, closed accounts, customer service problem, reputation risk, etc. Our main question is can we process the debits? We will handle the rest.

Our marketing department would like to advertise "Free ATM use" - when the customer is actually charged for the ATM fees charged by other banks and then we rebate the fee at the end of the cycle. I say no - because the money is coming out of the account and may not be rebated until nearly a month later. Your thoughts?

If a customer pays all the HELOC fees in cash, are we required to include detail of the fees paid on the first statement?

I am with a bank in rural south Texas. Many of our customers are small ranchers. They often have informal names for their operations such as ABC Cattle Co. There are no papers filed-it's just what they call themselves. I assume it is best practice to require that they file an assumed name certificate but some of these customers have been with us for 25+ years and they don't see any need. My question is: What would you recommend as our policy when these customers want to cash checks payable to ABC Cattle Co and there is no account open in that name?
